An important Act for the future subdivision of New South Wales into separate colonies, namely Victoria in 1851 and Queensland in 1859. The Act describes the possible need for separation, given the 'great extent' of New South Wales as the entire eastern portion of the Australian continent. Governing this vast area from Sydney posed serious problems of communication and effective administration, and discontent with the existing system was becoming increasingly obvious by the time this Act was passed in 1840.

This Act allows Queen Victoria to appoint Legislative Councils for the new colonies, who may draft new laws subject to approval before parliament in Britain. This provision was to be especially important in the case of Victoria, where separation from New South Wales was soon followed by the gold-rushes. Here began a period of unprecedented population growth and economic change wherein political self determination was of great importance.
